<strong>Regional</strong> <strong>Basic</strong> <strong>Professional</strong> <strong>Tra<strong>in</strong><strong>in</strong>g</strong> <strong>Course</strong> (BPTC) on Nuclear Safety<br />

unsafe conditions.<br />

All enforcement decisions shall be confirmed to the operator <strong>in</strong> writ<strong>in</strong>g. The extent of the<br />

authority of the regulatory <strong>in</strong>spectors to take on‐the‐spot enforcement actions shall be<br />

determ<strong>in</strong>ed by the regulatory body.<br />

Where on‐the‐spot enforcement authority is not granted to <strong>in</strong>dividual <strong>in</strong>spectors, the<br />

transmission of <strong>in</strong>formation to the regulatory body shall be suited to the urgency of the<br />

situation so that necessary actions are taken <strong>in</strong> a timely fashion. Information shall be<br />

transmitted immediately if the <strong>in</strong>spectors judge that the health and safety of workers or<br />

the public or the protection of the environment are endangered.<br />

3.7.4.4. Development of regulations and guides<br />

The system of regulations and guides shall be chosen to suit the legal system of the<br />

Member State, and the nature and extent of the facilities and activities to be regulated.<br />

When the regulatory body does not issue regulations, the legislative and governmental<br />

mechanisms shall ensure that such regulations are developed and approved with<strong>in</strong><br />

appropriate timescales.<br />

The ma<strong>in</strong> purpose of regulations is to establish requirements with which all operators<br />

must comply. Such regulations shall provide a framework for more detailed conditions<br />

and requirements to be <strong>in</strong>corporated <strong>in</strong>to <strong>in</strong>dividual authorizations.<br />

Guides, of a non‐mandatory nature, on how to comply with the regulations shall be<br />

prepared, as necessary. These guides may also provide <strong>in</strong>formation on data and methods<br />

to be used <strong>in</strong> assess<strong>in</strong>g the adequacy of the design, analyses and other documentation<br />

submitted to the regulatory body by the operator.<br />

When develop<strong>in</strong>g regulations and guides, the regulatory body shall take <strong>in</strong>to<br />
