Competition authorities have the mandateboth to investigate and to sanction the misconduct of undertakings. Suchextensive powers should be balanced with the introduction of guarantees ofprocedural fairness: the right to be heard, the right to equal participationin the proceedings, the right of defence, the right to protection of businesssecrets and other confidential information and the right to judicial reviewand judicial control over administrative proceedings.The author investigates the meaning of the concept of procedural fairnessin the international law (in particular as enshrined in the EuropeanConvention on Human Rights), EU law and Polish constitutional law aswell as in the opinions of legal theoreticians.
