A class <strong>of</strong> biological reference points, referred to as non-equilibrium<br />

measures <strong>of</strong> spawning potential ratio, that have been proposed and used to<br />

measure current stock status with respect to overfishing are reviewed. These<br />

are commonly used as reference points for <strong>fisheries</strong> in the southeastern U.S.<br />

(e.g. red snapper and mackerel) but were omitted from the report Scientific<br />

Review <strong>of</strong> Definition <strong>of</strong> Overfishing in U.S. Fishery Management Plans. <br />

Example calculations for simulated and real fish stocks are included. The<br />

report recommends the adoption <strong>of</strong> static and transitional SPR as a measure <strong>of</strong><br />

overfishing and in rebuilding plans, respectively.<br />

A stylized model <strong>of</strong> a set <strong>of</strong> Gulf <strong>fisheries</strong> is developed to investigate<br />

the bioeconomic characteristics <strong>of</strong> bycatch problems. The simulation run<br />

isolate three distinct effects attributable to the introduction <strong>of</strong> a bycatch<br />

reduction device (BRD) into the fishery for stock X; a bycatch catchability<br />

effect; an operating cost effect; and a target species catchability effect.<br />

The BRD does not result in increases in stock size for species Y, it does<br />

increase recreational and commercial fishing effort for species Y<br />

substantially, and it increases fishing pressure in the fishery for species X.<br />

This article explores contemporary debates over property rights in<br />

United States <strong>fisheries</strong> in the context <strong>of</strong> the public trust doctrine. The<br />

debate surrounding the privatization <strong>of</strong> harvesting rights in the halibut and<br />

sablefish <strong>fisheries</strong> <strong>of</strong>f Alaska is used as a case study. The public trust<br />

perspective guides a new reading <strong>of</strong> the Alaska debate <strong>of</strong>fering insight into<br />

current conceptualizations <strong>of</strong> both property rights in <strong>fisheries</strong> and the public<br />

trust doctrine itself. A contextual analysis <strong>of</strong> the early public trust<br />

doctrine reveals a strong symmetry between the debate over the early doctrine<br />

and that over the Alaska <strong>fisheries</strong>. both are debates over fundamental ideas<br />

regarding the interrelationships between natural resources, rights, equity,<br />

progress, and nationhood. A public trust-driven reading <strong>of</strong> the Alaska debate<br />

reveals how much our ideas about rights, and consequently about the public<br />

trust doctrine itself, have changed. In our quest for environmental<br />

preservation we have all but abandoned earlier public trust doctrine in<br />

exchange for the malleability <strong>of</strong> current articulations <strong>of</strong> the doctrine.<br />
