NMFS proposes to institute a limited access system for the <strong>fisheries</strong>, develop<br />

eligibility criteria for participating in the <strong>fisheries</strong> based on historical<br />

participation, specify rules for transferability <strong>of</strong> permits, and prohibit the<br />

possession or sale <strong>of</strong> swordfish or sharks caught incidentally as bycatch in<br />

<strong>fisheries</strong> targeting other species (e.g., tuna). The intent <strong>of</strong> this regulation<br />

is to cap commercial harvesting capacity at recent historic levels to prevent<br />

additional vessels from entering these <strong>fisheries</strong> thus leading to additional<br />

overcapitalization.<br />
