Le Quaker Penn, qui au sein de sa fédération admet renqiloi de la
force comme sanction, va même jusqu'à prévoir la contrainte comme
moyen de créer l'organisation rêvée par lui. C''est une idée extrêmement,
nous doutons qu'elle ait été admise par aucun autre auteur.

Au fond, quelle serait la sanction d'un refus ? Il n'y aurait guère d'autre
recoiu's que celui d'une guerre punitive. Il faut croire qu'il n'a envisagé
ce recours que comme vltima ratio. En dernier heu Penn envisage l'objec-
tion la plus grave, en tout cas l'objection toujours avancée, ,, that
sovereign princes and states will hereby become not sovereign : a thing
they will never endure " (p. 14). Il répond en faisant la distinction
entre les deux aspects de la souveraineté : ,, they remain, dit-il, as sover-
eign at home as ever they were. Neither their power over their people,
nor the usual revenue they pay them, is diminished . . . So that the sove-
reignties are as they were, for none of them hâve now any over one
another : And if this be called a lessening of their power, it must be
only because the great fish can no longer eat up the little ones, and that
eacli sovereignty is equally defended from injuries, and di.sabled from
committing them :

La distinction que veut établir Penn entre l'aspect intérieur et
l'aspect extérieur de la souveraineté paraît plutôt un ,, argument uni
ad hominem " ; il ne nous retiendra pas. De toute façon il y aura perte
de souveraineté, puisque les Etats doivent s'incliner devant la volonté
de la communauté, ,, the European league or confederacy ". Cette
perte de souveraineté est inévitable ; elle est implicite dans la création
de la ,, league and confederacy ". Une autre question est celle de savoir
si ce sacrifice de la souveraineté serait à déplorer, et s'il n'y aurait pas,
à tout prendre, davantage à y gagner, même pour l'Etat le plus puissant.
