The author explains the concept ofstalking and outlines its social and legal aspects. The author specificallydescribes the incomplete scope of legal and criminal protection against stalkingand follows it with the government’s submission to expand it in order toinclude a new type of offence with complementary statutory features i.e.persistent harassment. This proposal is analysed with regard to the basicrules of criminalization – suitability, necessity and proportionality, and theattention is drawn to the prevention of negative indications of stalking ona non-legal level within so called pre-criminal policy.
