Eutanazja w nauczaniu i prawie Koœcio³a katolickiego oraz w prawie polskim413SummaryEuthanasia in the teaching and law of the Catholic Churchand Polish lawThe author of this article attempts to answer the question, whethera human has a right to decide about his own or others death; irrespectively ifwe consider a suicidal death, or committed on someone’s demand, by anauthorized person to do so. To achieve that, the author has referred to thedoctrinal as well as legal regulations, applicable in Poland, at least to thesethat apply to two biggest communities in Poland: the community of citizensof the Republic of Poland and the community of the Catholic Church inPoland. However, he has previously analyzed the phenomenon of euthanasia,its concept-definitions and forms.In the teaching and law of the Church, as well as in accordance withpolish law, each and every human life, also of an old or ill person, should beprotected. An article 38 of the applicable Constitution of the Republic ofPoland, protecting the human life, is a constitutional law rule, indicatinghow to form other legal norms and make the administrative decisions.A legalized euthanasia may become a desirable tool of a totalitariansystem, dividing people into “able to live in the modern country” and “theinvaluable beings”. An alternative for euthanasia is: 1) to develop the palliativemedicine, 2) to facilitate a way to come by a peaceful end of life for illpeople in the terminal states, 3) to develop the networks of the hospices.
