that included the phrase “within internati<strong>on</strong>ally recognized<br />

borders.” Such insistence was obviously because<br />

of Russian recogniti<strong>on</strong> of the former Georgian<br />

provinces of Abkhazia <str<strong>on</strong>g>and</str<strong>on</strong>g> South Ossetia <str<strong>on</strong>g>and</str<strong>on</strong>g> the c<strong>on</strong>tinued<br />

presence of Russian forces <strong>on</strong> their territory.<br />

By the summer of 2011 the Russian Deputy Foreign<br />

Minister Aleks<str<strong>on</strong>g>and</str<strong>on</strong>g>r Grushko declared that the negotiati<strong>on</strong>s<br />

had “ended up in an impasse” <str<strong>on</strong>g>and</str<strong>on</strong>g> blamed the<br />

West for this development. 22<br />

The failure to achieve agreement <strong>on</strong> the framework<br />

document prior to the September 2011 Review C<strong>on</strong>ference,<br />

with the 4th anniversary of the Russian suspensi<strong>on</strong><br />

of participati<strong>on</strong> in the agreement now rapidly receding,<br />

has left Washingt<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> its <str<strong>on</strong>g>NATO</str<strong>on</strong>g> allies with<br />

few choices. On November 22, 2011, the United States<br />

announced that “it would cease carrying out certain<br />

obligati<strong>on</strong>s” under the treaty with regard to the Russian<br />

Federati<strong>on</strong>. 23 <str<strong>on</strong>g>NATO</str<strong>on</strong>g> allies quickly followed suit<br />

with similar announcements. 24 In additi<strong>on</strong>, the United<br />

States <str<strong>on</strong>g>and</str<strong>on</strong>g> its allies argued that sharing of sensitive<br />

data by treaty signatories with the Russian Federati<strong>on</strong><br />

should be c<strong>on</strong>sidered a compliance violati<strong>on</strong> as<br />

the data is supposed to be provided <strong>on</strong>ly to “active”<br />

participants in the agreement.<br />

It does, however, seem clear that American <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

<str<strong>on</strong>g>NATO</str<strong>on</strong>g> policymakers do not wish to terminate the<br />

treaty or argue that the Russian Federati<strong>on</strong> is in “material<br />

breach.” This is clear in a number of ways. First,<br />

the announcement reaffirmed the U.S. willingness to<br />

implement the treaty <str<strong>on</strong>g>and</str<strong>on</strong>g> carry out all obligati<strong>on</strong>s with<br />

the other signatories. Sec<strong>on</strong>d, it offered to resume full<br />

implementati<strong>on</strong> with Moscow should it decide to return<br />

to compliance. Finally, the United States declared<br />

that in the spirit of transparency it will “voluntarily<br />
