forces in Europe. 25 Thus the November 22, 2011,<br />

announcement appears simply to acknowledge that,<br />

after 4 years, the United States <str<strong>on</strong>g>and</str<strong>on</strong>g> its <str<strong>on</strong>g>NATO</str<strong>on</strong>g> partners<br />

could not c<strong>on</strong>tinue to fulfill treaty obligati<strong>on</strong>s absent<br />

some reciprocity from Moscow. But this U.S. reacti<strong>on</strong><br />

may offer an opportunity to bypass the logjam that has<br />

occurred for the past 4 years. It could clear the agenda<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> allow negotiati<strong>on</strong>s to commence that c<strong>on</strong>sider<br />

other areas of mutual interest between Russia <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

<str<strong>on</strong>g>NATO</str<strong>on</strong>g> as well as other c<strong>on</strong>venti<strong>on</strong>al arms proposals.<br />

The failure to find a soluti<strong>on</strong> that would have allowed<br />

the Adapted CFE Treaty to enter into force was<br />

clearly a disappointment. Still American <str<strong>on</strong>g>and</str<strong>on</strong>g> European<br />

policymakers can take some solace from the fact<br />

that during the 4-plus years since the Russian Federati<strong>on</strong><br />

suspended its participati<strong>on</strong>, the Alliance has been<br />

able to maintain internal unity <strong>on</strong> the issue. It seems<br />

clear in retrospect that the Russian Federati<strong>on</strong> firmly<br />

believed that over time some <str<strong>on</strong>g>NATO</str<strong>on</strong>g> members would<br />

in fact “break ranks” <str<strong>on</strong>g>and</str<strong>on</strong>g> seek to ratify the Adapted<br />

CFE Treaty. At a minimum, the Federati<strong>on</strong> hoped that<br />

the issue would cause increased fricti<strong>on</strong> am<strong>on</strong>g alliance<br />

members. Clearly this did not occur. Of course, it<br />

is important to realize that the Russian war with Georgia<br />

did serendipitously serve to enhance <str<strong>on</strong>g>NATO</str<strong>on</strong>g> unity.<br />

It is also important to realize that the partial cessati<strong>on</strong><br />

of U.S. <str<strong>on</strong>g>and</str<strong>on</strong>g> its Allies’ participati<strong>on</strong> may complicate<br />

efforts to begin a new round of negotiati<strong>on</strong>s.<br />

A few states may need to terminate the existing CFE<br />

Treaty in order to begin discussi<strong>on</strong>s of a new agreement<br />

in order to comply with domestic legal requirements.<br />

Some legal experts believe that this could be<br />

accomplished by reopening the Adapted Treaty negotiati<strong>on</strong>s<br />

while maintaining the existing number of<br />
