Gender (Male v Female). The results found children appeared to have an understanding of
criminal intent and saw provocation as a mitigating factor. However, children were unable to
foresee the consequences of a violent act, either short or long term. These results will be discussed
in relation to doli incapax legislation.

Violence against the child in South Africa assumes many forms, ranging from emotional and
sexual abuse to physical and medical and nutritional neglect. There are no proper laws to prevent
discrimination against children. Hence, there is a need to analyse and revisit the laws, especially
the existing provisions relating to sexual molestation and rape, their implementation and effects on
the child in South Africa. The law as it exists is unable to protect the child and is insufficient to
address the violence or coercion he or she may experience.

The research question proposes was about what stages followed by judge in making decision
whether defendant was guilty or not? Were the stages similar to the theory of narration model by
Pennington and Hastie? This research utilized a qualitative approach, which was analysing ten of
judge's decision criminal case of murder. Result from this research showed that judges in
Indonesia followed different stages, compared to the theory of Pennington Hastie. Indonesian
judges have five stages to make decision guilty in criminal case. From this research, we can know
the limitations in the stages of sentencing processes on Indonesianjudges.

There is a lack of studies on the relationship between severe mental disorders and violent
offending in unselected sexual offender groups. Thus, the role of psychiatric morbidity as a
potentially valuable source of clinical information in sex offender risk assessments remain unclear.
The current study explored the association between psychiatric morbidity and violent reoffending
among all offenders convicted of at least one sexual offence during 1988-2001 (N=9,108). The
data was further compared with a control group of 50,000 subjects from the general population.
Implications for risk assessment in clinical practice will be discussed.
