La Narrativa de Henry Fielding y la Sociedad Inglesa del Siglo XVIII
En Amelia, el incidente en el que está implicado el suegro de Trent, ya
aludido en varias ocasiones, ilustra otro de los problemas de la presentación de
pruebas y la aceptación de testimonios ante la ley en el siglo XVIII. Este
hombre falsifica el nombre de otra persona en un título, un delito mayor, pero
se le absuelve porque la víctima no puede testificar ya que la ley que regía la
presentación de pruebas descalificaba a todos los testigos que pudiesen tener
intereses en la acción. Algunos historiadores de la ley interpretan esto
únicamente como un interés pecuniario, y Burn dice que:
“In many criminal cases, from the necessity of the thing, interested persons are
allowed as witnesses. As where the owner prosecutes an indictment of felony for stolen goods,
he is concerned in interest; for he will be entitled to restitution; and yet his evidence is
admitted. ... But upon an indictment for battery or the like, the party grieved may be a
witness against the defendant, because the prosecution is at the suit of the King.” 137
Por otra parte, Holdsworth indica que desde finales del siglo XVII el
principio de descalificación por motivo de interés se aplicaba tanto en los
procesos criminales como civiles. 138 Fielding alude a esta limitación en la
aceptación de testigos en Tom Jones, cuando Allworthy juzga a Partridge al que
se acusa de ser el padre del supuesto hijo ilegítimo de Jenny Jones. Se dice
también que Allworthy aceptó el testimonio de Mrs. Partridge contra su
marido, y comete una injusticia, ya que ésta comete perjurio y Partridge se ve
privado de sus ingresos (II, 6). Fielding hace notar el error de Allworthy
expresando la sabiduría de las leyes de Inglaterra:
“...I make a just compliment to the great wisdom and sagacity of our law, which refuses to
admit the evidence of a wife against her husband. This, says a certain learned author who I
believe was never before quoted before in any but a law book, would be the means of much
perjury, and of much whipping, fining imprisoning, transporting and hanging.” 139
Fielding dejó bastante documentación de su trabajo en la magistratura.
