In Force for transportation of Felons; and all Marriages solemnized<br />

from and after the Twenty fifth Day of March, in the year One<br />

thousand seven hundred and fifty four, in any other P<strong>la</strong>ce than a<br />

Church or a Publick Chapel, unless by Special Licence as<br />

aforesaid, or that shall be solemnized without Publication of Banns,<br />

or Licence of Marriage from a Person or Persons having Authority<br />

to grant the same, first had and obtained, shall be null and void to<br />

all Intents and Purposes whatsoever.<br />

Provi<strong>de</strong>d, That all Prosecutions for such Felony shall be<br />

commenced within the Space of three Years after the Offence<br />

committed<br />

Provi<strong>de</strong>d always, That after the Solemnization of any Marriage,<br />

un<strong>de</strong>r a Publication of Banns, it shall not be necessary in Support<br />

of such Marriage, to give any Proof of the actual Dwelling of the<br />

Parties in the respective parishes or Chapelries wherein the Banns<br />

of Matrimony were published; or where the Marriage is by<br />

Licence, it shall not be necessary to give any Proof that the usual<br />

P<strong>la</strong>ce of Abo<strong>de</strong> of One of the Parties, for the Space of Four weeks<br />

as aforesaid, was the Parish or Chapelry where the Marriage was<br />

solemnized; nor shall any Evi<strong>de</strong>nce i9n either of the said Cases be<br />

received to prove contrary in any Suit touching the validity of such<br />

Marriage.<br />

And it is hereby further enacted, That all Marriages solemnized by<br />

Licence, after the said Twenty fifth Day of March, in the year One<br />

thousand seven hundred and fifty four, where either of the Parties,<br />

not being a Widower or Widow, shall be un<strong>de</strong>r the Age of Twenty<br />

one years, which shall be had without the Consent of the Father of<br />

such of the Parties, so un<strong>de</strong>r Age (if then living) first had and<br />

obtained, or if <strong>de</strong>ad, of the Guardian or Guardians of the Person of<br />

the Party so un<strong>de</strong>r Age, <strong>la</strong>wfully appointed, or One of them; and in<br />

case there shall be no such Guardian or Guardians, then of the<br />

Mother ( if living and unmarried) or if there shall be n o Mother<br />

living and unmarried, then a Guardian or Guardians of the Person<br />

appointed by the Court of Chancery, shall be absolutely null and<br />

void to all intents and Purposes whatsoever.<br />

And whereas it may happen, that the Guardian or Guardians,<br />

Mother or Mothers, of the Parties to be married, or One of them, so<br />

un<strong>de</strong>r the Age As aforesaid may be Non Compos Mentis, or may<br />

be in Parts beyond the Seas, or may be induced unreasonably, and<br />

by undue Motives to abuse the Truth reposed in him, her or them,<br />

by refusing or with-holding his her Consent to a proper Marriage;<br />

be it therefore enacted, That in case any such guardian or<br />

Guardians, Mother or Mothers, or any of them, whose Consent<br />
