Gentry seguían la legislación al pie de la letra, ya que no querían tener dudas ni
litigios a cuenta de las propiedades o las herencias. 62
Las explicaciones de Blackstone al respecto parecen ambiguas, pero
reflejan la posibilidad de una mujer de rechazar un pretendiente deforme, ya
que, según parece, la aversión física o moral era considerada motivo suficiente
para expresar un rechazo. Western, sin embargo, ignora esta posibilidad legal
ya que quiere obligar a Sofía a casarse con Blifil a pesar de la aversión que
siente por él. 63 No obstante, los matrimonios clandestinos forzados con
herederas menores, una vez que se probaban, eran declarados nulos y se
sancionaban duramente. Blackstone explica que:
“if any person, above the age of fourteen, unlawfully shall convey or take
away any woman child unmarried … within the age of sixteen years, from the
possession and against the will of the father, mother guardian or governors, he shall
be imprisoned two years, or fined at the discretion of justices: and if he deflowers
such maid … or, without the consent of the parents contracts matrimony with her,
he shall be imprisoned five years, or fined … and she shall forfeit all her lands to
her next of kin, during the life of her said husband.” 64
Estas medidas estaban pensadas para evitar que el marido pudiese entrar
en posesión de las propiedades de ella. De hecho, no se castigaba al hombre
por seducir a la mujer sino por tomar posesión ilegal de una propiedad.
Blackstone indica que se debía probar “that the woman has substance either real or
personal, or is an heir apparent.” También se debía probar que había sido llevada
contra su voluntad y “that she was afterwards married or defiled”. Incluso si habia
consentido “to the marriage or defilement ... being won thereunto by flatteries after the
taking” se consideraba de todas formas un delito mayor “if the first taking were
against her will.” 65
Una vez que los acuerdos del matrimonio habían sido convenidos, la
boda, como en tiempos pasados, era una de las maneras en las que las familias
aristocráticas hacían ostentación de su riqueza, y suponía un indicativo de su
poder.
