CHAPITRE PREMIER DROIT ROMAIN [342] Le délit est essentiellement l'acte illicite. Les sociologues ont insisté, après DURKHEIM, sur le caractère « contraignant » de la vie sociale. Délit, péché ou tabou se rejoignent dans la notion d'impureté : tout contact impur, toute violation d'un interdit, suscite une réaction de la conscience collective. Le crime « crie vengeance », il appelle une sanction, il engendre des représailles ou la guerre; ainsi en est-il entre les nations. La répression peut être affaire privée ou affaire familiale. La puissance publique, quand elle existe, s'interpose. L'Etat intervient non pour se substituer à la vengeance privée, mais pour la discipliner dans l'intérêt de la paix. L'acte illicite a engendré un déséquilibre qu'il convient de réparer, la victime et ses représentants sont seuls juges de l'importance et de la nature de la réparation. [343] DÉLIT PRIVÉ ET DÉLIT PUBLIC. — Si le créancier est souvent le maître du contrat, l'accord de volontés est nécessaire à l'engagement contractuel, les obligations, quand elles sont réciproques, s'inspirent des principes de justice commutative. Il en va tout autrement des obligations délictuelles romaines, catégorie juridique difficile à comprendre pour un esprit moderne. Il existe de nos jours une distinction fondamentale entre délit civil et délit pénal. Le premier « n'est pris en considération que s'il a entraîné un préjudice pour une autre personne » (RIPERT et BOULANGER, II, n° 907). « Le dommage (ou préjudice) causé à autrui sous certaines conditions oblige celui qui l'a causé à le réparer » (CARBONNIER, I, n° 44). Préjudice-réparation, l'équilibre est rétabli. Le délit pénal, au contraire, « existe même s'il n'a pas causé de dommage... La peine
