issue of the Youth Forum is a learning process, as you yourself have said. We would hope to learn from it and to
develop from it. We ourselves are quite concerned that our youth from the developing countries should also
participate in this Youth Forum, and their voices be added to those of the other young people who have met and
will continue to meet in the future. But, Madam President, as we struggle with the modalities of how best our
youth from developing countries can be represented, we hope that this learning process will continue and not be
disrupted. The fact is that representation of youth, particularly rural youth to whom the Chairperson of the Youth
Forum appealed, presents a problem to us in terms of how best they may be represented at the General
Conference; but in the meantime I fully endorse your sentiment and the sentiment of the Chairperson of the
Youth Forum and we hope that UNESCO will continue to support such activities.
9. The PRESIDENT:
I thank the distinguished delegate of Kenya. I see no more comments. The General Conference takes
note of the Youth Forum's conclusions; no doubt the questions raised will be taken up in the future.

10.1 The PRESIDENT:
We now turn to item 6.4 of the General Conference agenda, Draft amendment to Article VI,
paragraph 2, of the Constitution. You may recall that on the recommendation of the General Committee, the
General Conference decided to examine, during this additional meeting of the plenary, the report of the Legal
Committee on item 6.4 in order to take a decision on this issue prior to the election of the Director-General. May
I remind you that in conformity with Rule 88, paragraph 1, a two-thirds majority of the Members present and
voting is required to amend the Constitution.
10.2 Having said this, and taken note that several delegates have requested the floor, I now invite the
Chairperson of the Legal Committee to take the floor.
11.1 Sr. FERNÁNDEZ (Chile), Presidente del Comité Jurídico:
Señora Presidenta, distinguidos delegados: Como determinó el propio Comité Jurídico, daré lectura
integral a este sexto informe del Comité Jurídico (30 C/78 y Add. y Corr.), y acto seguido daré respuesta, a las
preguntas que los señores delegados puedan presentar, si las hay.
11.2 Sexto informe, punto 6.4 del orden del día, documento 30 C/50 y Add., "Proyecto de modificación del
párrafo 2 del Artículo VI de la Constitución": El Comité Jurídico examinó el documento 30 C/50 y Add. relativo
a un proyecto de modificación del párrafo 2 del Artículo VI de la Constitución. Este proyecto, presentado por
Nueva Zelandia, tiene por objeto limitar a un máximo de ocho años el mandato del Director General. Según las
disposiciones vigentes, el mandato por un periodo de seis años puede ser prorrogado una vez por un segundo
mandato de igual duración, totalizando así un periodo de doce años que, a juicio del autor del proyecto, es
demasiado prolongado para una organización de la importancia de la UNESCO. Por consiguiente, se propone
limitar la duración del segundo mandato a dos años solamente. El Canadá presentó luego una propuesta destinada
a modificar la mencionada enmienda a fin de limitar cada mandato a cuatro años.
11.3 El Comité Jurídico se limitó a examinar los aspectos jurídicos y de procedimiento de las dos enmiendas,
en la medida en que la elección de la duración del mandato del Director General es una cuestión política. El
Comité comprobó que estas enmiendas habían sido comunicadas a los Estados Miembros en los plazos previstos,
de conformidad con los Artículos 113 y siguientes del Reglamento de la Conferencia General, y que su
aprobación por la Conferencia General no supone modificaciones fundamentales de los fines de la Organización
ni nuevas obligaciones para los Estados Miembros (Artículo XIII.1 de la Constitución).
11.4 En opinión del Comité Jurídico, son jurídicamente admisibles ambas propuestas de modificación: la
propuesta de Nueva Zelandia de modificar la Constitución (documento 30 C/50) de conformidad con el Artículo
113 del Reglamento, y la modificación propuesta de esta enmienda presentada por el Canadá (documento
30 C/50 Add.), de conformidad con el Artículo 114. De ser aprobada, la modificación entraría en vigor
