1.1 The PRESIDENT:
I thank those who are on time, but in the absence of a quorum shall postpone the meeting for five
minutes.

1.2 I declare open the twenty-fourth plenary meeting of the General Conference. This morning’s meeting
will be devoted to the examination of the reports of the Legal Committee and the report of Commission I.
1.3 Ladies and gentlemen, Mr Director-General, we shall now proceed with the examination of the reports
of the Legal Committee on items 5.1, 5.3, 6.1, 6.2, 6.3, 6.5, 6.6 and 6.7 of the agenda. In view of the fact that
some of those items were also examined by Commissions I, II and III, and by the Administrative Commission,
their consideration by the Legal Committee was carried out by order of priority. That is why I wish to propose
that you examine the reports of the Legal Committee in their chronological order and not according to their order
on the agenda. I remind you that we have already had the opportunity to examine the sixth report of the
Committee relating to item 6.4 - the draft amendment to Article VI, paragraph 2, of the Constitution - andthe
ninth report relating to item 3.3 - examination of draft resolutions - during the eighteenth plenary meeting on the
afternoon of 10 November. I should like to add for your information that the Legal Committee also considered a
matter submitted to it by Commission I relating to the legal validity of an agreement. The report on this question
has been conveyed to Commission I.
1.4 I now invite the Chairperson of the Legal Committee to present the first report of the Committee on
item 6.1, “Adoption of the Statutes of the UNESCO Institute for Statistics”. The related document is 30 C/73,
and there is an addendum and corrigendum in Spanish only. I give the floor to the Chairperson of the Legal
Committee.
2.1 M. FERNÁNDEZ (Chili), Président du Comité juridique :
Merci beaucoup. Madame la Présidente, Monsieur le Président du Conseil exécutif, Monsieur le
Directeur général, je me propose donc de vous présenter tout d'abord le premier rapport du Comité juridique,
relatif à l'adoption des statuts de l'Institut de statistique de l'UNESCO (documents 30 C/73, 30 C/73 Add. et Corr.
pour la version espagnole).
2.2 Les statuts de cet Institut ont déjà reçu l'aval du Conseil exécutif. Le Comité juridique leur a apporté de
légères modifications et la Commission I a fait de même. La version finale du texte est celle que cette
Commission a établie et qui figure dans son rapport (document 30 C/61, pages 10 et suivantes dans la version
française).
2.3 Le projet de la Commission I diffère de celui du Comité juridique sur les deux points suivants : dans le
projet de résolution, au paragraphe 4, la Commission I a ajouté "permanente" après "lieu d'implantation" ; à
l'article II, paragraphe 2, des statuts de l'Institut, la Commission I a supprimé les mots "menées dans le cadre de
l'autonomie dont jouit".
2.4 Le Comité juridique a pour sa part formulé deux recommandations : l'une à l'attention du Conseil
d'administration de l'Institut sur la nécessité de clarifier, dans son règlement intérieur, ses procédures de
fonctionnement, notamment en cas de vote ; l'autre à l'attention du Directeur général sur la nécessité d'assurer la
représentation de différentes régions du monde lorsqu'il nommerait les membres du Conseil d'administration. Je

3.1 The PRESIDENT:
Thank you, Mr Fernández. So you heard the slight difference between the proposals of the Legal
Committee and of Commission I. As this was also considered by Commission I, I suggest that the best way to
proceed would be for us to decide on this item when we consider the report of Commission I. Are there any
