note du rapport du Comité juridique et a recommandé "que, sur la base d'une proposition préparée par le
Secrétariat, suite, entre autres, à une consultation avec des membres du Comité juridique de la 30e session de la

Madam President, I have just been appointed Secretary-General of our National Commission and I have
not had a chance to study this issue. I was wondering if you or the Rapporteur could summarize for me the legal
difficulties connected with the document. I only received a copy of it yesterday. I would hate to delay the
proceedings this morning, but I need to understand the critical legal problems raised by this particular document.

Thank you. I will ask Mr Fernández to comment on this but in any case I am going to suggest that we do
not make any decision now but just take note of the report and deal with the matter when Commission I presents
its report. I give the floor to Mr Fernández.

Muchas gracias, señora Presidenta: En realidad, la discusión del Comité Jurídico se centró
exclusivamente en aspectos técnico-jurídicos. Sin embargo hubo distintas posiciones, que fue preciso dirimir
mediante votación. En líneas generales, los principales inconvenientes aparecidos se refieren a determinadas
insuficiencias técnicas y legales en el proyecto que fue analizado. Aunque fue una discusión realmente difícil,
enriqueció de manera notable el debate. La opinión generalizada, a pesar de la votación, es que esto debería ser
revisado en profundidad y analizado lo antes posible por el propio Comité o alguna otra instancia. Muchas
gracias, señora Presidenta.

Merci beaucoup, Madame la Présidente. En réalité, les débats du Comité juridique ont porté
exclusivement sur des aspects technico-juridiques. Toutefois, des points de vue différents se sont exprimés, entre
lesquels il a fallu se prononcer par un vote. En règle générale, les principales objections ont porté sur certaines
insuffisances techniques et juridiques du projet qui a été examiné. Bien que les discussions aient été
particulièrement rudes, elles ont été très enrichissantes. L'opinion générale est qu'en dépit du vote, ce projet devrait
être révisé en profondeur et analysé le plus rapidement possible par le Comité lui-même ou par toute autre instance.

rise to most discussion. If you would be so kind as to explain very briefly, and I shall then suggest that it be

16. Ms KLEMEN-KREK (Slovenia):
Madam President, I would like to express the opinion of the Slovenian delegation on the situation here.
The Slovenian Government pays special attention to the role of the National Commission in its country, and
considers it a focal point for cooperative relations between Slovenia and UNESCO and vice versa. Indeed, the
importance of the National Commissions should be underlined in all UNESCO documents and activities. When
we go through the reports of the Legal Committee, we see that they provided a precise legal wording for all the
items it discussed with the exception of this one. I therefore expressed, in Commission I, my delegation’s
disappointment with the work of the Legal Committee, which had not been capable of providing legal advice but
