1618 All orders of the Court shall be entered in the register maintained by both Court Clerk at Head Office and Bandra Office and this register shall be inspected by ALA/ALO every week to ensure that appropriate actions are taken in the matter. CLA, LA, DyLA’s & ALA’s are assigned certain courts for correspondence and for follow up with Retainer Advocates. These Officers shall scrutinize the briefs and highlight any action which remains to be taken and make suggestions on any law point to the Retainer Advocate. Any information which such Officers feel is necessary for the case is obtained by correspondence with the concerned departments and forwarded to the Retainer Advocates. After the cases are disposed off, the connected exhibits shall be filed and the entries in the register of application shall be made. The Court Clerk at Bandra Office shall make an application to the Court to withdraw the original papers filed in the Court and shall return these original papers to Head Office on receipt of the same. The Court Clerk at Head Office shall return these papers to concerned departments. Summary of all such cases shall be drawn and figures of monthly disposal of cases shall be maintained. The proceedings before the Labour Court are usually under the BIR Act, 1946 since the <strong>Undertaking</strong> is governed by the BIR Act. The orders passed by the Labour Courts may be challenged in the Industrial Court by filing an appeal. Complaints under the Maharashtra Registration of Trade Union and Prevention of Unfair
1619 Labour Practices Act, 1971 (MRTU & PULP Act) are filed either before the Labour Court or the Industrial Court depending upon the relevant provisions/schedule under which the complaint is filed. The Industrial Court also have the powers to entertain revision application against the order of the Labour Court in respect of complaints under the MRTU & PULP Act, 1971. The Officers of the Legal Department also appear and defend matters before the Labour Court/ESI Court, Payment of Wages and Workmen’s Compensation Court and References.
