person, taking into consideration that the Court of Justice is routinely confronted with
lawsuits brought by private educational institutions that are prone to questioning the
fullness of the inclusive educational system.
A descriptive bibliographic research was developed. The data were collected in Laws,
documents and scientific articles related to the subject in question. The results indicate
that the Judicial Branch, through the Supreme Court of the State of Maranhão, with
adequate legal reasons satisfactorily performed its task of ensuring the validity of the
rules contained in the Person Statute with Disabilities, especially the one forbidding the
collection of additional amounts, the educational institutions, solely because of the
student's being a person with a disability. It is known, however, that the realization of
these fundamental rights depends on the efforts concentrated not only by the Judiciary,
but also from the other components of the State Justice System, namely the Public
Prosecutor's Office, Maranhão State Lawyers and Municipality of São Luís, the Private
Law Office (OAB), the Public Defender, etc. Finally, it is indicated through the screen
survey (notwithstanding the preliminary data) that the position of the State Court of
Maranhão reveals institutional behavior consistent with the general principles and
guidelines of the Brazilian Inclusion Law, some lawsuits attempt in the interests of
persons who have been deprived of their liberty have been slow to be tried, which may
lead to the perpetuation of the violation of such rights and guarantees, to the detriment
of those most interested, namely, citizens affected by long-term physical, mental,
intellectual or sensorial illnesses.
