person, taking into consideration that the Court of Justice is routinely confronted with<br />

lawsuits brought by priv<strong>ate</strong> educational institutions that are prone to questioning the<br />

fullness of the inclusive educational system.<br />

A descriptive bibliographic research was developed. The data were collected in Laws,<br />

documents and scientific articles rel<strong>ate</strong>d to the subject in question. The results indic<strong>ate</strong><br />

that the Judicial Branch, through the Supreme Court of the St<strong>ate</strong> of Maranhão, with<br />

adequ<strong>ate</strong> legal reasons satisfactorily performed its task of ensuring the validity of the<br />

rules contained in the Person Statute with Disabilities, especially the one forbidding the<br />

collection of additional amounts, the educational institutions, solely because of the<br />

student's being a person with a disability. It is known, however, that the realization of<br />

these fundamental rights depends on the efforts concentr<strong>ate</strong>d not only by the Judiciary,<br />

but also from the other components of the St<strong>ate</strong> Justice System, namely the Public<br />

Prosecutor's Office, Maranhão St<strong>ate</strong> Lawyers and Municipality of São Luís, the Priv<strong>ate</strong><br />

Law Office (OAB), the Public Defender, etc. Finally, it is indic<strong>ate</strong>d through the screen<br />

survey (notwithstanding the preliminary data) that the position of the St<strong>ate</strong> Court of<br />

Maranhão reveals institutional behavior consistent with the general principles and<br />

guidelines of the Brazilian Inclusion Law, some lawsuits attempt in the interests of<br />

persons who have been deprived of their liberty have been slow to be tried, which may<br />

lead to the perpetuation of the violation of such rights and guarantees, to the detriment<br />

of those most interested, namely, citizens affected by long-term physical, mental,<br />

intellectual or sensorial illnesses.<br />
