Artur R. Sypuła, Review of global legislation in the scope of the solutions adopted in the area
of management of the archive materials constituting non-public archive resources in Poland. The article
lists and discusses legislation applicable in selected states (mostly European ones) that includes
regulations governing the procedures of conduct related to archive materials equivalent to the archive
materials classified in Poland as non-public archive resources. Based on the legal solutions introduced
in individual states, the author distinguishes four models of the related governance — Roman,
German, Anglo-Saxon and post-communist. As the primary criteria of classification, he considers the
degree of statutory interference in the freedom of disposal of archive materials by their owners and the
method of exercising rights of the archives vis-a-vis developers of the law governing the non-public
archives.
Artur R. Sypuła, Revue de la juridiction mondiale dans le domaine des solutions relatives au
traitement des documents d’archives non etatique en Pologne. Le présent article constitue un relevé et
commentaire des dispositions juridiques en vigueur dans les pays choisis (principalement européens),
contenant des régulations relatives à la gestion des documents d’archives qui constituent des équivalents
des documents d’archives appartenant en Pologne au fonds non étatique d’archives. En se basant sur
les solutions juridiques introduites dans les différents pays, l’auteur a distingué quatre modèles de
régulation en la matière : romain, germanique, anglo-saxon et postcommuniste. Le critère de base de
cette division était le degré d’intervention juridique dans la liberté de disposer de matériaux d’archives
par leur propriétaire, ainsi que les modalités de l’exercice de compétences envers les créateurs des
documents d’archives du domaine privé.
Артур Р. Сыпула, Обзор мирового законодательства в сфере решений, касающихся
обращения с архивными материалами образующими негосударственный архивный фонд
Польши. Статья представляет собой сводку и анализ правовых норм, действующих в некоторых
государствах (в основном европейских) и содержащих регулирования, касающиеся
обращения с архивными материалами, относимыми в Польше к таковым и образующими
негосударственный архивный фонд. На основании характера правовых решений, которые
применяются в отдельных государствах, автор выделил четыре модели регулирования —
романскую, германскую, англосакскую и посткоммунистическую. Основным критерием
разделения явилась степень публично-правового вмешательства в свободу распоряжения
архивными материалами их владельцами и способ осуществления полномочий архивов по
отношению к создателям архивируемых документов в частной сфере.
