Constitution, legal acts, administrative regulations, and the common law. The Constitution is the most
important source of law, prescribing the scope of a federal law (primary to the state law).
The most important document defining the legal bases of the National Archives in the USA is
Public Painting and Documents, title 44 United States Code, USC). It comprises legal regulations
governing, among other things, the establishment and organisation of the National Archives of the
USA, repositories of presidential documents, the archives’ Trust Fund, a committee for historical publications,
as well as issues related to the management of the documentation and information resources,
the protection of classified information, and publishing and popularization activities. Secondary legislation
governing the archives is provided for in different parts of the US Code, executive regulations
of the US President, and other types of legal provisions.

pour définir les cadres juridiques de fonctionnement des archives nationales. Le système juridique
américain est basé sur quatre sources : la constitution, les dispositions juridiques, les dispositions
administratives et le droit coutumier — common law. La source la plus importante est la constitution
qui détermine les limites de la loi fédérale (supérieure par rapport à la loi des États).
Le document le plus important qui détermine les bases juridiques des Archives nationales des
États-Unis est la section 44 du Code des États–Unis (Public Painting and Documents, title 44 United
States Code — USC). On y trouve les dispositions juridiques concernant la création et l’organisation des
Archives nationales des États–Unis, référentiels de documents présidentiels, biens fiduciaires d’archives,
commission de publications historiques, ainsi que des questions liées à la gestion de la documentation
et des ressources informationnelles, à la protection de la documentation classifiée, l’activité éditoriale
et de popularisation. Les dispositions juridiques complémentaires, relatives aux archives se trouvent
dans différentes sections du Code des États-Unis, dans les mesures exécutoires du président des États-
-Unis et dans d’autres dispositions juridiques.
