The Relevancy of Anti-Dumping Act Towards Malaysia Counterparts for
Protection of Domestic Industries in Global

This paper examines how the relevancy of Anti-Dumping act can protect domestic
industries in global. According to WTO and GATT (Article IV), anti-dumping determined
by calculating antidumping margins where it means the difference between the price
export and domestic goods that was been sold in exporting country. It recognized
officially at the GATT 1994, and used primarily by United States (US), European Union
(EU), Canada and Australia which do have active antidumping legislation. Literature
review used for studying previous research about anti-dumping which is related to
author research. According to Amanda Bolderston (2008), literature review can be an
informative, critical, and useful synthesis of a particular topic. It can identify what is
known and unknown in the subject area, identify areas of controversy or debate, and
help formulate questions that need further research. The more quantity of imported
goods than exported goods and the lack of enforcement in price control system be the
main issues that led to dumping in the particular countries. So, why relevant measures
requirements should be used to increase enforcement in terms of price control and
which solution can be used by the authorities to ensure the balancing activities of
import and export. This action taken by authorities to strengthen the enforcement on
price control and to balance the import and export. This research use benchmarking
theory. According to John P. Moriarty, (2011) a theory of benchmarking sufficient
methodological elements contributing to establish them within an acceptable
theoretical framework. Then, finding in this research can be shown when Malaysia
take New Zealand as role model in enact the Anti-Dumping in order to protect domestic
industries in global because that country is the powerful in use Anti-Dumping. As
conclusion, anti-dumping act has been adopted in the country which suffered by
dumping from other country.
